§ 1 Scope

For business relationships between us and the purchaser, the following General Terms and Conditions apply to orders placed via the online shop, in the version valid at the time of the order.

§ 2 Conclusion of Contract

The presentation of our products on our website merely constitutes an invitation to the customer to submit a contractual offer.

By submitting an order, the customer makes an offer within the meaning of § 145 of the German Civil Code (BGB). The customer receives an email confirmation of receipt of the order.

A contract with us is concluded when we accept the customer's offer in writing or in text form within 2 working days after the order has been sent. The relevant time is when the declaration of acceptance is received by the customer.

A working day is any calendar day that is not a Sunday or a nationwide public holiday in Germany.

§ 3 Delivery, Shipping Costs, Transfer of Risk

Delivery is made at the shipping costs specified in each individual case. If the customer is a consumer, we bear the shipping risk in all cases, regardless of the shipping method. If the customer is a business, all risks and dangers of shipment pass to the customer as soon as the goods have been handed over by us to the contracted logistics partner. The buyer always bears the cost of returns.

§ 4 Retention of Title

The delivered goods remain our property until full payment of the purchase price.

§ 5 Payments

Only the payment methods displayed to the customer during the ordering process will be accepted.

§ 6 Liability for Defects

Statutory liability for defects applies.

If the customer is a business within the meaning of § 310 (1) BGB, the following applies in deviation:

Regardless of the following provisions for shortening the warranty period for new goods, the limitation period for claims for damages due to injury to life, body, or health based on an intentional or negligent breach of duty by us or our legal representatives or agents remains unaffected. Furthermore, regardless of the following provisions for shortening the warranty period for new goods, the limitation period for claims for damages for other damages based on an intentional or grossly negligent breach of duty by us or our legal representatives or agents remains unaffected. Any liability under the Product Liability Act also remains unaffected.

Otherwise, for new goods, a warranty period of one year applies if the customer is a business. Otherwise, the statutory regulations apply.

§ 7 Information for Consumers on Distance Contracts and Customer Information for Contracts in Electronic Commerce

a) We are not subject to any special and not previously mentioned codes of conduct.

b) You can identify and correct any input errors when submitting your order during the final confirmation before sending your contractual declaration, using the delete and change functions at any time before submitting the order.

c) The essential characteristics of the goods we offer and the validity period of limited offers can be found in the individual product descriptions on our website.

d) The language available for concluding the contract is German.

e) Complaints and claims for liability for defects can be submitted to the address specified in the provider identification.

f) The contract text is not stored by us and is therefore not accessible to you as a customer after the conclusion of the contract.

g) Please refer to the offer for information on payment, delivery, or fulfillment.

§ 8 Information on Dispute Resolution Procedures before a Consumer Arbitration Board

We are neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.

§ 9 Miscellaneous

The contractual relationship between us and the customer and the respective terms and conditions are subject to the law of the Federal Republic of Germany. If the customer is a consumer, the mandatory legal provisions and rights of the state in which the consumer has their habitual residence, which may not be deviated from by agreement, remain unaffected by this agreement. The application of the UN Convention on Contracts for the International Sale of Goods is excluded.
